1. Agreement to Terms

Welcome to Galeon Charters. These Terms of Service ("Terms") govern your use of our website located at galeoncharters.web.app and our yacht charter services in Malta.

By accessing our website or using our services, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access our services.

2. Our Services

Galeon Charters provides luxury yacht and boat charter services in Malta, including:

  • Yacht and boat rentals
  • Sunset experience packages
  • Skippered and self-charter options
  • Corporate and private event hosting
  • Customized maritime experiences

All services are subject to availability, weather conditions, and compliance with local maritime regulations.

3. Booking and Reservations

3.1 Reservation Process

Bookings can be made through our website, WhatsApp, or direct contact. All reservations are subject to:

  • Availability confirmation
  • Receipt of required deposit
  • Completion of necessary documentation
  • Compliance with safety requirements

3.2 Confirmation

Your booking is confirmed only when you receive written confirmation from us. We reserve the right to decline any reservation at our discretion.

4. Payment Terms

4.1 Pricing

All prices are displayed in Euros (€) and include applicable taxes unless otherwise stated. Prices are subject to change without notice until your booking is confirmed.

4.2 Payment Schedule

  • Deposit: 50% of total charter fee required upon booking
  • Final Payment: Remaining balance due 7 days before charter date
  • Additional Costs: Fuel, catering, and extras payable on charter day

4.3 Security Deposit

A refundable security deposit may be required to cover potential damages or additional costs. This will be clearly communicated during the booking process.

5. Cancellation and Refund Policy

5.1 Client Cancellation

  • More than 14 days: Full refund minus 10% administrative fee
  • 7-14 days: 50% refund
  • Less than 7 days: No refund
  • No-show: No refund

5.2 Weather Cancellation

If weather conditions are deemed unsafe by our captain or local authorities:

  • Full rescheduling to available date, or
  • Full refund if rescheduling is not possible

5.3 Operator Cancellation

We reserve the right to cancel charters due to mechanical issues, weather, or force majeure events. In such cases, clients will receive a full refund or rescheduling option.

6. Safety and Client Responsibilities

6.1 Safety Requirements

  • All passengers must follow safety briefings and instructions
  • Life jackets must be worn when required
  • Swimming is at your own risk
  • No smoking on board (except designated areas)
  • Alcohol consumption must be responsible

6.2 Prohibited Items

  • Illegal substances
  • Weapons or dangerous items
  • Excessive alcohol (captain's discretion)
  • Red wine or staining beverages (vessel protection)

6.3 Captain's Authority

The captain has absolute authority regarding safety, navigation, and conduct on board. Failure to comply with captain's instructions may result in early termination without refund.

7. Liability and Insurance

7.1 Our Liability

We maintain comprehensive marine insurance and operate under strict safety protocols. However, water activities involve inherent risks, and clients participate at their own risk.

7.2 Limitation of Liability

Our liability is limited to the charter fee paid. We are not responsible for:

  • Personal injury due to client negligence
  • Loss or damage to personal belongings
  • Indirect or consequential damages
  • Weather-related disappointments

7.3 Client Insurance

We strongly recommend clients obtain travel and activity insurance covering water sports and boat activities.

8. Damage and Loss

Clients are responsible for any damage to the vessel or equipment caused by negligence or misuse. Costs will be deducted from the security deposit or charged separately.

Normal wear and tear is expected and not charged to clients.

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

10. Intellectual Property

All content on our website, including text, images, logos, and design elements, is protected by copyright and trademark laws. You may not use our content without explicit written permission.

Clients grant us permission to use photos and videos taken during charters for marketing purposes unless explicitly opted out.

11. Force Majeure

We are not liable for delays or cancellations due to circumstances beyond our control, including but not limited to:

  • Extreme weather conditions
  • Government restrictions or regulations
  • Natural disasters
  • Port closures or maritime emergencies
  • Pandemics or health emergencies

12. Governing Law and Disputes

These Terms are governed by the laws of Malta. Any disputes will be resolved through:

  1. Good faith negotiation
  2. Mediation if necessary
  3. Maltese courts as a last resort

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated "Last updated" date. Continued use of our services constitutes acceptance of revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
